{"id":4757,"date":"2022-11-29T20:03:51","date_gmt":"2022-11-30T03:03:51","guid":{"rendered":"https:\/\/chf-ca.papercrane.ca\/projet-de-loi-23-loi-de-2022-visant-a-accelerer-la-construction-de-plus-de-logements-possibilites-et-preoccupations-pour-le-logement-abordable-en-ontario\/"},"modified":"2026-03-24T16:14:53","modified_gmt":"2026-03-24T22:14:53","slug":"projet-de-loi-23-loi-de-2022-visant-a-accelerer-la-construction-de-plus-de-logements-possibilites-et-preoccupations-pour-le-logement-abordable-en-ontario","status":"publish","type":"post","link":"https:\/\/chf-ca.papercrane.ca\/fr\/projet-de-loi-23-loi-de-2022-visant-a-accelerer-la-construction-de-plus-de-logements-possibilites-et-preoccupations-pour-le-logement-abordable-en-ontario\/","title":{"rendered":"Projet de loi 23, Loi de 2022 visant \u00e0 acc\u00e9l\u00e9rer la construction de plus de logements : possibilit\u00e9s et pr\u00e9occupations pour le logement abordable en Ontario"},"content":{"rendered":"<p>Hier, l\u2019Ontario a adopt\u00e9 le projet de loi\u00a023, la <em>Loi de\u00a02022 visant \u00e0 acc\u00e9l\u00e9rer la construction de plus de logements.<\/em> Le projet de loi apporte de nombreux changements importants \u00e0 diverses lois provinciales, notamment la <em>Loi sur les redevances d\u2019am\u00e9nagement, <\/em>la<em> Loi sur les municipalit\u00e9s<\/em>, la <em>Loi sur la cit\u00e9 de Toronto <\/em>et la <em>Loi sur l\u2019am\u00e9nagement du territoire<\/em>.<\/p>\n<p>La FHCC est heureuse de constater que les redevances d\u2019am\u00e9nagement seront \u00e9limin\u00e9es pour tous les projets de coop\u00e9ratives et d\u2019organismes \u00e0 but non lucratif \u00e0 l\u2019\u00e9chelle de la province. Ce changement aura des r\u00e9percussions tangibles et positives sur la viabilit\u00e9 du d\u00e9veloppement de nouveaux logements coop\u00e9ratifs. Nous sommes \u00e9galement heureux de constater que la province s\u2019engage \u00e0 revoir le r\u00e9gime d\u2019imp\u00f4t foncier pour les coop\u00e9ratives et les organismes \u00e0 but non lucratif. De nombreux organismes \u00e0 but non lucratif doivent payer le m\u00eame taux d\u2019imp\u00f4t foncier que les propri\u00e9taires de logements locatifs priv\u00e9s, voire m\u00eame un taux plus \u00e9lev\u00e9 que celui qui serait factur\u00e9 \u00e0 un propri\u00e9taire priv\u00e9. Cela peut repr\u00e9senter une charge importante pour une coop\u00e9rative dont le mandat est de fournir des logements abordables.<\/p>\n<p>Nous sommes toutefois pr\u00e9occup\u00e9s par les r\u00e9percussions des changements suivants\u00a0:<\/p>\n<ul>\n<li>La province a r\u00e9duit les redevances d\u2019am\u00e9nagement et les redevances pour avantages communautaires que les municipalit\u00e9s peuvent percevoir sur les nouveaux am\u00e9nagements de logements \u00e0 but lucratif. Ces redevances d\u2019am\u00e9nagement sont souvent utilis\u00e9es pour soutenir les services de logement, notamment les services destin\u00e9s aux personnes en situation d\u2019itin\u00e9rance et le d\u00e9veloppement de nouveaux logements abordables, y compris des coop\u00e9ratives d\u2019habitation. En pleine crise du logement abordable, il est urgent de remplacer le financement provenant des droits d\u2019am\u00e9nagement et des redevances pour avantages communautaires destin\u00e9s au logement abordable et \u00e0 la lutte contre l\u2019itin\u00e9rance par un programme provincial robuste et \u00e0 long terme qui soutient la construction de nouveaux logements abordables, y compris des coop\u00e9ratives, et qui aide les personnes en situation d\u2019itin\u00e9rance.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<ul>\n<li>La province a restreint l\u2019utilisation du zonage d\u2019inclusion en le limitant \u00e0 5\u00a0% des unit\u00e9s dans un d\u00e9veloppement et en limitant l\u2019abordabilit\u00e9 \u00e0 25\u00a0ans. Des coop\u00e9ratives d\u2019habitation pourraient \u00eatre d\u00e9velopp\u00e9es par le biais d\u2019un zonage d\u2019inclusion, mais ces limitations, en particulier le plafond d\u2019abordabilit\u00e9 de 25\u00a0ans, rendront cette entreprise presque impossible.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<ul>\n<li>La province a le pouvoir, par l\u2019entremise du projet de loi\u00a023, d\u2019\u00e9liminer les r\u00e8glements municipaux sur le remplacement des logements locatifs. Les r\u00e8glements de remplacement des logements locatifs peuvent obliger les promoteurs \u00e0 proposer des logements locatifs au m\u00eame prix si des locataires ont \u00e9t\u00e9 d\u00e9plac\u00e9s lors du r\u00e9am\u00e9nagement de ces logements. Ce changement met en danger les locataires \u00e0 revenu faible et mod\u00e9r\u00e9 alors que les taux d\u2019inoccupation sont tr\u00e8s bas dans toute la province et que les listes d\u2019attente pour les logements sociaux sont tr\u00e8s longues.<\/li>\n<\/ul>\n<ul>\n<li>La province a limit\u00e9 la capacit\u00e9 des municipalit\u00e9s \u00e0 int\u00e9grer des normes environnementales vertes en mettant en \u0153uvre des mesures de contr\u00f4le des plans d\u2019implantation. Les normes \u00e9cologiques contribuent \u00e0 r\u00e9duire les co\u00fbts \u00e0 long terme et \u00e0 garantir la qualit\u00e9 des logements pour les utilisateurs finaux, tels que les membres des coop\u00e9ratives d\u2019habitation. Elles contribuent \u00e9galement \u00e0 rendre les b\u00e2timents plus r\u00e9sistants aux pannes d\u2019\u00e9lectricit\u00e9 et encouragent l\u2019utilisation d\u2019\u00e9nergies renouvelables et d\u2019\u00e9nergies de quartier.<\/li>\n<\/ul>\n<p>La FHCC est impatiente de collaborer avec la province pour att\u00e9nuer ces pr\u00e9occupations et s\u2019assurer que, dans le cadre de son objectif qui consiste \u00e0 construire 1,5\u00a0million de nouveaux logements, la province veille \u00e0 ce qu\u2019une proportion appropri\u00e9e de logements soient construits \u00e0 un prix abordable pour les m\u00e9nages \u00e0 faible et \u00e0 moyen revenu, y compris par la construction de nouvelles coop\u00e9ratives d\u2019habitation.<\/p>\n<p>La FHCC participera \u00e0 plusieurs des consultations qui ont \u00e9t\u00e9 amorc\u00e9es par la province dans le cadre du projet de loi\u00a023 au cours des prochaines semaines.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Hier, l\u2019Ontario a adopt\u00e9 le projet de loi\u00a023, la Loi de\u00a02022 visant \u00e0 acc\u00e9l\u00e9rer la construction de plus de logements.
