Cette nouvelle l\u00e9gislation comprend une modification de la <em>Loi sur les associations coop\u00e9ratives<\/em> qui permet aux coop\u00e9ratives de tenir leurs assembl\u00e9es g\u00e9n\u00e9rales annuelles et leurs r\u00e9unions de r\u00e9solution sp\u00e9ciale de mani\u00e8re virtuelle, \u00e0 condition que leurs r\u00e8glements ne l\u2019interdisent pas.<\/p>\n<p>Le bureau de la R\u00e9gion de l\u2019Atlantique de la FHCC a demand\u00e9 cette modification au d\u00e9but de\u00a02021, apr\u00e8s qu\u2019il est devenu \u00e9vident, pendant la pand\u00e9mie, qu\u2019il \u00e9tait n\u00e9cessaire de rendre cette flexibilit\u00e9 permanente.<\/p>\n<p>Dans une lettre adress\u00e9e au gouvernement le 20\u00a0janvier\u00a02021, la FHCC a \u00e9crit\u00a0:<\/p>\n<p>Au nom des coop\u00e9ratives d\u2019habitation de la Nouvelle-\u00c9cosse, nous demandons qu\u2019une modification soit apport\u00e9e \u00e0 la <em>Loi sur les associations coop\u00e9ratives<\/em> afin de permettre les r\u00e9unions virtuelles. L\u2019\u00e9tat d\u2019urgence en vigueur permet aux coop\u00e9ratives de tenir toutes leurs r\u00e9unions en ligne conform\u00e9ment aux mesures de sant\u00e9 et de s\u00e9curit\u00e9 li\u00e9es \u00e0 la COVID-19. Toutefois, une fois l\u2019\u00e9tat d\u2019urgence lev\u00e9, la loi ne permettra pas la tenue de r\u00e9unions de r\u00e9solution sp\u00e9ciale en ligne. Nous pensons qu\u2019il s\u2019agit l\u00e0 d\u2019une modification de la r\u00e9glementation indispensable \u00e0 la continuit\u00e9 des activit\u00e9s des coop\u00e9ratives, \u00e0 la prise de d\u00e9cisions dans le cadre d\u2019un processus d\u00e9mocratique et au soutien du secteur \u00e0 long terme.<\/p>\n<p>En effet, les modifications apport\u00e9es \u00e0 la loi autorisent les coop\u00e9ratives \u00e0 tenir toutes leurs r\u00e9unions en ligne si cette solution convient aux membres de leur conseil d\u2019administration. Cette disposition ne supplante pas les r\u00e8glements administratifs des coop\u00e9ratives, qui permettent explicitement d\u2019interdire les r\u00e9unions virtuelles quand cela s\u2019av\u00e8re n\u00e9cessaire.<\/p>\n<p>La loi permet \u00e9galement de tenir des r\u00e9unions par le biais de \u00ab\u00a0proc\u00e9d\u00e9s t\u00e9l\u00e9phoniques ou \u00e9lectroniques\u00a0\u00bb. Ainsi, une coop\u00e9rative d\u2019habitation pourrait tenir des r\u00e9unions par conf\u00e9rence t\u00e9l\u00e9phonique, par visioconf\u00e9rence ou par une combinaison des deux.<\/p>\n<p>\u00ab\u00a0Cette modification de la loi permettra maintenant aux coop\u00e9ratives de statuer sur la meilleure fa\u00e7on d\u2019\u00e9liminer les obstacles \u00e0 l\u2019engagement des membres dans leur coop\u00e9rative et d\u2019appuyer un principe fondamental des coop\u00e9ratives\u00a0: le pouvoir d\u00e9mocratique des membres, a d\u00e9clar\u00e9 la gestionnaire de la R\u00e9gion de l\u2019Atlantique de la FHCC, Karen\u00a0Brodeur.\u00a0Des personnes qui n\u2019\u00e9taient auparavant pas en mesure d\u2019assister \u00e0 des r\u00e9unions en personne pourraient d\u00e9sormais avoir l\u2019occasion de s\u2019impliquer davantage dans leur collectivit\u00e9.\u00a0\u00bb<\/p>\n<p>&nbsp;<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Le mois dernier, l\u2019Assembl\u00e9e l\u00e9gislative de la Nouvelle-\u00c9cosse a adopt\u00e9 le projet de loi\u00a0138, An Act to Permit Virtual Business Meetings (loi autorisant les r\u00e9unions d\u2019affaires virtuelles).
